On establishment of the Assembly of people of Kazakhstan

The Decree of the President of the Republic of Kazakhstan dated March 1, 1995 N 2066 abolished by the Decree of President dated April 26, 2002 N 856 ~ P020856

            In order to strengthen social stability and interethnic harmony in the Republic of Kazakhstan and in accordance with Article 78 of the Constitution of the Republic of Kazakhstan decree:

            1. To establish the Assembly of people of Kazakhstan as an advisory body under the President of the Republic of Kazakhstan.

            2. To approve the Regulations of the Assembly of people of Kazakhstan (attached).

            3. To convene the first session of the Assembly of people of Kazakhstan, on March 24, 1995

            4. The Cabinet of Ministers of the Republic of Kazakhstan - to consider and resolve issues related to the first session of the Assembly of people of Kazakhstan.

            . This Decree shall enter into force on the date of publication.

Regulations of

the Assembly of people of Kazakhstan

I. General regulations

            1. The Assembly of people of Kazakhstan (hereinafter - the Assembly) is an advisory body to the President of the Republic of Kazakhstan.

            2. The Assembly carries out its activities:

            in accordance with the Constitution, laws, acts of the President of the Republic of Kazakhstan and these Regulations;

            on the principles of equality of members, publicity, democracy, personal responsibility of members of the Assembly for the activities within it;

            in close cooperation with government agencies, public, including religious associations, bodies of territorial public self-government in the Republic of Kazakhstan, as well as international and other organizations in other countries, whose activities are not contrary to the aims and objectives of the Assembly.

            3. Decisions of the Assembly are advisory character.

II. The goals, objectives and main directions

of the Assembly activities

            4. The purpose of the Assembly is to develop of the political situation in the republic of practical recommendations based on the assessment of events and forecasts, for consolidating society, and to assist the President of the Republic of Kazakhstan in his activities as guarantor of the rights and freedoms of the citizens of Kazakhstan irrespective of their racial, ethnic or social origin , religion and opinion.

            5. Activities of the Assembly focused on the following objectives:

            contribute to the preservation of ethnic harmony and stability in the country;

            develop proposals for public policies conducive to the development of friendly relations between the nationalities living on the territory of Kazakhstan, promoting their spiritual and cultural revival and development based on respect for the principle of equality;

            the formation of political culture of citizens, basing on civilized and democratic norms;

            supporting the integration of varied national interests in the government’s national policy;

            search for compromises to resolve the emerging social contradictions in society.

            6. The main activities of the Assembly are:

            project development concepts and programs of spiritual development of the society in the near and distant future, discuss them in government and among the public, to promote their implementation;

            participate in the formation of public opinion in support of democratic reforms;

            development of recommendations and participation in the implementation of practical measures to resolve social differences and disputes, conflict resolution;

             exchange of information with foreign organizations;

      interdepartmental coordination of activity on development and strengthening of interethnic relations;

            socio-legal examination of draft laws on national policy. <*>

III. Members of the Assembly

            7. The Assembly is formed by the President of the Republic, approved by him in quantitative composition of the number of representatives of national cultural centers, councils of veterans and other persons with regard to their authority among the population, socio-political activity, experience of practice.

            Candidates for members of the Assembly on the proposals of the national-cultural centers are nominated by the Council or session of small assemblies of regions, Astana and Almaty cities. Candidates from republic associations and government bodies are recommends by the Executive Secretariat of the Assembly. All nominations are considered at a meeting of the Council of Assembly and submitted for approval to the President of the Assembly of People of Kazakhstan. First President of the Republic of Kazakhstan has the right to reject the nominations, enter in the Assembly, at his discretion others. <*>

            8. Small Assemblies of people of Kazakhstan:

            acts as a consultative and advisory bodies under the heads of the regional administrations;

            are formed in each region from the representatives of the national-cultural centers, veterans' councils, regional administrations and maslikhats;

            led by the heads of regional administrations, who claim their personal structure;

            activities are guided by Constitution, laws, acts of the President of the Republic of Kazakhstan and these Regulations.

IV. Rights and obligations of members of the Assembly

            9. Members of the Assembly have rights to:

            discuss the practical activities of the Assembly;

            express their views, both before and after the decision by Assembly;

            suspend their participation in the activities, or to withdraw from the Assembly.

            As part of the Assembly minority is guaranteed the right to freedom of opinion and positions. This minority does not have the right to speak on behalf of the Assembly and prevent the implementation of the decisions taken.

            10. Members of the Assembly must:

            act in accordance with the Constitution, laws, acts of the President of the Republic of Kazakhstan and these Regulations;

            actively participate in achieving the aims and objectives of the Assembly;

            care about the authority of the Assembly and actively promote its ideas and activities;

            conscientiously implement the orders of the Assembly.

V. The organization and procedure of the Assembly

            11. The Chairman of the Assembly is the President of the Republic of Kazakhstan.

            The Assembly has deputy Chairmen appointed by the President of the Republic on the proposal of the Assembly.

            12. The Assembly is convened by the President of the Republic of Kazakhstan. The date, venue and the proposed agenda of the Assembly announced a month before the Assembly start to work.

            The Assembly meets at least once a year.

            13. The Extraordinary Assembly is convened by the President of the Republic of Kazakhstan on its own initiative or at the request of at least one third of the members of the Assembly and carried out within one month from the date of decision.

            14. The Assembly has a quorum if it is attended by not less than two thirds of the members of the Assembly. Decision of the Assembly shall be considered adopted if supported by an affirmative vote of more than half of the present members of the Assembly. The form of voting in the decision determines by Assembly.

15. The Assembly has rights to:

            consider proposals to amend or supplement these Regulations and submit them for approval to the President of the Republic of Kazakhstan;

            take the concept and target programs of the Assembly;

            hear reports of the members of the Assembly;

            submit a proposal to the President of the Republic of Kazakhstan by the majority not less than two-thirds of the members of the Assembly on its reorganization or termination of activities of the Assembly and its bodies;

            address and resolve other issues falling within the competence.

            16. To maintain the work between the meetings of the Assembly of People  of Kazakhstan by decision of the President of the Republic forms the Council of the Assembly from the representatives of national cultural centers, councils of veterans, heads of small assemblies, as well as other persons who are members of the Assembly. <*>

VI. The management structure and funding of the Assembly

17. The general management of the Assembly of People  of Kazakhstan is realizing by the Chairman of the Assembly - the First President of the Republic of Kazakhstan.

The highest authority of Assembly is the session. Decisions of session recommendatory character.

Deputy Chairmen of the Assembly between sessions of the Assembly and meetings of Council headed the Council of the Assembly, direct the work of the Executive Secretariat of the Assembly, carry out executive functions, performed the individual instructions of the Chairman of the Assembly.

The working body of the Assembly is the Executive Secretariat, it is the part of the structural unit of the President Administration of the Republic of Kazakhstan. To establish that the responsible employees of executive secretariats of small assemblies are employees of regional akims staff, Astana and Almaty cities. <*> Footnote. 18. Financing of activity of the Assembly at the expense of budgetary funds of the republic and regions, as well as donations, which do not contradict the current legislation.

VII. The procedure for termination of the Assembly

19. The decision on the reorganization or termination of activities of the Assembly taken by the President of the Republic of Kazakhstan on its own initiative or at the request of at least two thirds of the members of the Assembly.

20. Information on reorganization or termination of activities of the Assembly shall be published in the press.
