EX-DEPUTY OF THE MAJILIS OFFERS TO LEARN AUSTRIAN EXPERIENCE IN DEVELOPMENT OF MEDIATION

Deputy of Mazhilis of Parliament of the first and second convocation, Ph.D. in Economics, writer Kemel Myrzageldy in the framework of the speech devoted to a Single Mediation Day in Kazakhstan spoke about the importance of the development of mediation in the country and that is to learn from the experience of foreign experts, correspondent of BNews.kz reports.

On the initiative of Assembly of people of Kazakhstan on August 3, Single Mediation Day is held throughout the country, timed to the adoption of the law “On mediation” (August 5, 2011).

Development of Mediation Institute is one of the important directions of the programme “Ruhani zhangyru”.

Our mediators should be competent and comprehensive: Civil Law, Civil Procedure Code, all legislative acts must be used when it is necessary. I am not going to judge the condition of the law, but the law is good. If there are any more changes, that's good. For my part, I would suggest giving the Supreme court the right to initiate legislation. It is wrong for the Government to initiate such laws. The Supreme court is a law enforcement body, they know better where there are gaps in the legislation, – Myrzageldy said.

He noted the importance of the Law “On mediation”, adding that the task of the mediator is to bring the parties together and suggest how to reach an agreement. Therefore, divorce, division of property and other issues of social relations is long overdue to be resolved through mediation.

–We need to learn from the experience of Austria, our civil rights are directed to the Anglo-Saxon system. All the legislation in the world works on it and it is necessary to learn the experience of Austria, the UK for Institute of mediation to work cohesively and interestingly. The most important thing is that we should promote it, write more articles, publish on television,– Kemel Myrzageldy said.

At present, Kazakhstan has signed memorandums of cooperation with more than 40 parties, including the Supreme court of Kazakhstan, Union of judges, Republican Bar Association, Republican Notary chamber, National chamber of health of Kazakhstan and National chamber of entrepreneurs “Atameken” within the development of a network of mediators for the prevention and resolution of conflicts, strengthening the legal culture of the population of APK.

17 mediation offices of APK work in the regional and city Houses of friendship. 829 mediation offices have been opened in districts and rural districts, mediation issues are also considered at the sites of the councils of public consent and councils of mothers of APK.

Today the total number of public (non-professional) mediators in Kazakhstan is 3169 people, in 2016, their number was 1097 people.

The number of applications submitted for 5 months of 2018 exceeded 9200, more than 3 thousand are solved at the consultation stage, 6117 mediation agreements have been concluded.

Mediation is a new form of alternative dispute resolution involving a third, neutral party. Mediation can be used in disputes on civil, labour, family and other legal relations, as well as in criminal cases of small and medium gravity.
